ezSIMConnect Telecom Inc. (“ezSIMConnect”, “we”, “us”, or “our”) respects your privacy and is dedicated to protecting Personal Data it collects. This Privacy Policy (“Policy”) explains how we collect, use, disclose, retain and protect Personal Data when you use our Services.

By using or continuing to use a Service, including visiting ezSIMConnect’s website or otherwise providing Personal Data to ezSIMConnect, you accept and consent to the practices described in this Policy.

2. Scope & Applicability

This Policy applies to Personal Data collected through our Services and to Covered Users of our Services. You are responsible for informing your Covered Users about this Policy and obtaining any required authorizations from them.

Definition — Personal Data. “Personal Data” means any information that can be used to identify you, directly or indirectly.

3. How We Collect Personal Data

We collect Personal Data in various ways, including when you:

  • register for an account or place an order;

  • use our Services or website;

  • contact customer support or otherwise communicate with us;

  • submit forms, respond to surveys or participate in promotions.

 

Cookies & similar technologies. We and our service providers use cookies, web beacons, local storage and similar technologies for operational, functional, performance, analytical and marketing purposes. We use third-party analytics (for example, Google Analytics). Non-essential cookies are set only after obtaining your consent via our cookie banner. 4. Types of Personal Data We Collect

We may collect the following categories of Personal Data:

  • Account & contact data: name, company, email, phone, billing address;
  • Payment data: billing information (card or bank data) processed by our payment processor;
  • Usage data: device info, IP address, browsing behavior, logs, interaction with our Services;
  • Support data: chat transcripts, call recordings, communications;
  • Transactional data: order and billing records;
  • Other data: any Personal Data you choose to provide.

5. How We Use Personal Data

We use Personal Data to:

  • provide, operate and improve our Services;
  • process and fulfill orders and payments;
  • communicate with you about your account, orders and support requests;
  • detect and prevent fraud, abuse and security incidents;
  • personalize content and marketing where permitted; and
  • comply with legal obligations.

We also use aggregated, de-identified data for analytics and service improvement.

6. Payment Processing

Payment information entered on our website is transferred to our third-party payment processor (for example, Stripe) for processing. Financial information may be encrypted and temporarily stored for logging and reconciliation by ezSIMConnect and our payment processor. Credit card numbers are used by the payment processor only for processing payments. ezSIMConnect has written agreements with its payment providers requiring appropriate security and confidentiality measures.

7. Legal Bases & U.S. Rights

This Policy is tailored for U.S. users and CCPA-style rights. Where other law applies to specific individuals, we will respect applicable legal requirements (including GDPR and regional rules) and provide supplementary notices where required.

U.S./CCPA-style rights include (where applicable):

  • Right to know/access categories and specific records of Personal Data collected;
  • Right to deletion of Personal Data (subject to legal exceptions);
  • Right to opt-out of the sale of Personal Data (if applicable);
  • Right to non-discrimination for exercising privacy rights;
  • Right to correction and portability where applicable.

8. Disclosure & Subprocessors

We may disclose Personal Data to third parties where necessary (law enforcement, regulators, fraud prevention) or to enable service delivery (payment processors, hosting providers, analytics vendors, messaging/BSP providers, and other subprocessors).

Subprocessors and Data Processing by Third Parties
(a) Authorized Subprocessors. Customer acknowledges and agrees that ezSIMConnect may engage third parties (“Subprocessors”) to process Personal Data in connection with the Services. A non-exhaustive list of Subprocessors (including the function/purpose each performs) is available upon request by contacting [email protected].

(b) Flow-Down Requirements. ezSIMConnect shall ensure that any Subprocessor is bound by written contractual terms that provide at least the same level of protection for Personal Data as set forth in this Policy and applicable data protection laws, including confidentiality, data security, breach notification, assistance with data subject rights, deletion/return of Personal Data, and audit/cooperation obligations.

(c) Required Safeguards. For any cross-border transfer of Personal Data, ezSIMConnect will implement appropriate safeguards as required by applicable law (e.g., Standard Contractual Clauses or other lawful transfer mechanisms). ezSIMConnect will ensure Subprocessors maintain appropriate technical and organizational measures to protect Personal Data commensurate with the measures set forth in this Policy.

(d) Notification and Objection. ezSIMConnect will provide Customer with prior written notice (via email to [email protected] or another agreed channel) of any intended engagement of a new Subprocessor, including the Subprocessor’s name, location, and a general description of the processing activities. Customer will have thirty (30) days from such notice to object in writing on reasonable grounds related to data protection. If Customer reasonably objects and the parties cannot reach agreement, ezSIMConnect will not appoint the Subprocessor and may propose an alternative. If the Subprocessor is required for legitimate operational reasons and no commercially reasonable alternative exists, the parties will cooperate to implement additional safeguards.

(e) Liability. ezSIMConnect remains responsible for the acts and omissions of its Subprocessors to the same extent ezSIMConnect would be liable if performing the services itself, except to the extent that ezSIMConnect proves it is not responsible for the event giving rise to the damage.

(f) Audit and Compliance. ezSIMConnect will make available information necessary for demonstrating compliance with its obligations regarding Subprocessors and will, upon Customer’s reasonable request and subject to confidentiality constraints, provide a summary of audit reports or certifications concerning Subprocessors (e.g., SOC 2, ISO 27001) or enable Customer to audit Subprocessor compliance under mutually agreeable terms and scheduling.

(g) Contact for Subprocessor List and Questions. To obtain the current list of Subprocessors, request details about a proposed Subprocessor, or raise an objection, contact [email protected].

9. International Transfers

ezSIMConnect may transfer Personal Data across borders. When transferring Personal Data from the EEA/UK or other jurisdictions requiring safeguards to countries lacking an adequacy decision, we rely on appropriate safeguards such as Standard Contractual Clauses, an adequacy decision, or other lawful mechanisms. 10. Data Retention

We retain Personal Data only as long as necessary for the purposes described and to meet legal, regulatory and tax obligations. Example retention periods:

  • Account data: retained while account is active + 2 years after termination;

  • Transaction records: retained up to 7 years for tax and audit;

  • Support records and communications: retained typically 3 years;

  • Network and access logs: retained for a defined period (e.g., 6–24 months), extended only when necessary for security, fraud prevention or legal claims.

11. Cookies, Tracking & Consent

12. Automated Decision-Making & Profiling

We may use automated processing to personalize content and offers. If a decision about you is made solely by automated means and produces legal or similarly significant effects, we will provide meaningful information, allow you to request human review, and enable you to contest the decision where required by law.

13. Children’s Privacy

Our Services are not intended for children under the minimum age in your jurisdiction (typically 13). We do not intentionally collect Personal Data from children. If you believe we have collected Personal Data about a child, contact [email protected].

14. Data Security & Breach Response

We implement reasonable technical and organizational measures to protect Personal Data. In the event of a Personal Data breach that may result in risk to your rights and freedoms, we will notify affected individuals and regulators as required by applicable U.S. law and other jurisdictional requirements and will take remedial steps. Where required by law (e.g., GDPR), we will notify relevant supervisory authorities without undue delay and, where applicable, within 72 hours.

15. Marketing & Communications

If you opt in to marketing communications, you may withdraw consent at any time by following the unsubscribe link in emails or by contacting [email protected]. We will honor opt-out requests promptly.

16. Access, Correction & Deletion

You can access and update certain Personal Data through your account portal. To request deletion or correction of Personal Data we hold, contact [email protected]. We will respond in accordance with applicable law.

17. Dispute Resolution & Enforcement

If you have a concern about our handling of Personal Data, contact [email protected]. If unresolved, U.S. residents may use our third-party dispute resolver at https://feedback-form.truste.com/watchdog/request or pursue remedies available under applicable law.

18. Changes to this Policy

We may update this Policy. For material changes we will provide at least 30 days’ notice where required by law. For other updates the amended Policy will be effective within 14 days of posting. Continued use of the Services after the effective date constitutes acceptance of the updated Policy.

19. Verification & Compliance

ezSIMConnect conducts periodic self-assessments and compliance reviews, provides employee privacy training, and maintains internal procedures to verify implementation of this Policy. A corporate officer signs a statement verifying such self-assessment at least annually.
